Grid Mobile Service Disclaimer and Terms of Use

1. Nature of Services

Grid Mobile is a Mobile Virtual Network Operator (MVNO) operating under LAC Ventures Group Limited Co. The services provided by Grid Mobile, including voice, data, messaging, and related wireless services (collectively, the “Services”), are delivered over networks owned and maintained by third-party carriers. As an MVNO, Grid Mobile does not own, control, or operate the underlying network infrastructure, including towers, backhaul, or core network components. The performance, availability, and quality of the Services are therefore dependent on the third-party networks and other factors outside Grid Mobile’s direct control.

2. No Guarantee of Service or Performance

All Services are provided “as-is” and without any warranty or guarantee, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted service. Grid Mobile makes no representations or assurances regarding network coverage, speed, latency, reliability, signal strength, or quality of service. Users acknowledge that service interruptions, slowdowns, dropped calls, or other performance issues may occur at any time for any reason, including but not limited to network congestion, maintenance, equipment failures, weather conditions, or unforeseen technical issues.

3. Non-Refundable Payments

All fees, charges, and payments for Grid Mobile services, including but not limited to monthly service fees, activation charges, SIM cards, plan add-ons, international calling, overage charges, or any other service-related payments, are strictly non-refundable. Payments made to Grid Mobile shall not give rise to any right of reimbursement, credit, or refund, regardless of service quality, interruptions, limitations, or user dissatisfaction. By purchasing or activating Services, users expressly acknowledge and accept that all payments are final.

4. No Service Level Agreement (SLA)

Grid Mobile does not provide, and expressly disclaims, any Service Level Agreement (SLA) or any formal commitment to uptime, service restoration, response times, or quality of service. While Grid Mobile may make reasonable efforts to respond to inquiries or resolve technical issues, users acknowledge and accept that Grid Mobile is under no obligation to maintain continuous, uninterrupted, or error-free service.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Grid Mobile, LAC Ventures Group Limited Co., and their respective officers, directors, employees, agents, affiliates, and partners shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to lost revenue, lost profits, loss of data, business interruption, personal inconvenience, or other losses arising out of or in connection with the Services. This limitation applies even if Grid Mobile has been advised of the possibility of such damages. Users expressly acknowledge and accept that the Services are used at their own risk.

6. Coverage and Network Limitations

While Grid Mobile leverages the infrastructure of major network carriers, coverage is not guaranteed at any particular location, and network performance may vary due to factors outside Grid Mobile’s control, including topography, building materials, interference, equipment limitations, and network congestion. Users should not rely on Grid Mobile services for emergency communications without confirming coverage and functionality.

7. User Acknowledgment and Agreement

By activating, using, or paying for Grid Mobile Services, users acknowledge that they have read, understood, and agreed to this disclaimer in its entirety, including all limitations, disclaimers, and non-refund policies. Users further acknowledge that the Services may be subject to temporary or permanent interruptions, performance degradation, or other limitations, and that Grid Mobile assumes no responsibility for any such interruptions or limitations.

8. Modifications

Grid Mobile reserves the right, in its sole discretion, to modify, suspend, or terminate any Service, or any part thereof, at any time and without prior notice, including modifying fees, coverage, or service terms. Continued use of the Services after any modifications constitutes acceptance of the updated terms.

9. Governing Law

This disclaimer and any disputes related to Grid Mobile services shall be governed by the laws of the jurisdiction in which Grid Mobile operates, without regard to conflict of law principles. Users agree that any legal action related to the Services shall be brought exclusively in the competent courts of such jurisdiction.

10. Entire Agreement

This disclaimer constitutes the entire understanding between the user and Grid Mobile regarding the Services and supersedes any prior agreements, representations, or communications. No oral statements, marketing materials, or third-party representations shall modify or override this disclaimer.
